These Terms of Service ("Terms") apply to 1902CIGAR.COM ("Site" or "us", operated by 1902CIGAR). By accessing or purchasing, you agree to be bound by these Terms. Please read these Terms, the Privacy Policy and Section V (Products and Returns) in full before use.

I. Online store terms

• This Site sells cigars and other tobacco products to adults aged 18 and over only. An active age-verification mechanism is in place: visitors must confirm that they are 18 or older before browsing the Site, and visitors under 18 are denied access;
• You must be at least 18 years old and legally eligible to purchase tobacco products in your country/region. By placing an order you declare and warrant that you meet these conditions;
• Do not use the products on this Site for any illegal purpose, and do not upload or spread viruses or malicious code;
• In the event of a violation of these Terms, we may suspend or terminate your use of the Site.

II. General conditions

We reserve the right to refuse or cancel any order, including in the event of suspected fraud, abnormal address, overpurchase, a delivery address located in a restricted territory under Section XVII, or an obviously incorrect price; we will notify you by email or in-app notification after cancellation and refund the paid amount.

III. Accuracy of information

The product descriptions, pictures, inventory and prices on this Site strive to be accurate, but errors and omissions cannot be ruled out. If key information is wrong, we will confirm with you before shipping, or cancel the order and give you a full refund.

IV. Price and service adjustments

Merchandise prices, shipping costs and promotions may be adjusted at any time, and adjustments will not affect orders that have been established and paid for.

V. Products and returns

Cigars are tobacco products and are subject to customs and quarantine regulations. Returns and exchanges without reason are generally not supported for non-quality problems. If the goods you receive are damaged, sent by mistake or have quality problems, please contact customer service and provide photos within 48 hours after signing for them, and we will process them under our refund policy.

VI. Delivery and customs clearance

The goods are shipped directly from the Hong Kong bonded warehouse, or you can choose to pick them up at our Macau store. Cross-border parcels must clear customs and may incur import duties or taxes, which shall be borne by the recipient; returns and losses caused by incorrect information, rejection or failure to clear customs in time shall be borne by the recipient.

VII. Account and billing information

You must ensure that your registration and order information is true, accurate, complete and kept up to date. You are responsible for keeping your account and password safe; we are not liable for losses caused by poor safekeeping.

VIII. Third-party tools and links

This Site may contain third-party services or external links, whose content and privacy practices are the responsibility of the third party; we assume no corresponding responsibility.

IX. User submitted content

Content you submit in reviews, pictures or messages is deemed authorized for display on this Site and related channels; you must ensure it does not infringe the rights of others and contains no illegal information.

X. Personal information

The processing of your personal information is governed by the Privacy Policy.

XI. Prohibited use

These Terms are governed by the laws of the Hong Kong Special Administrative Region. Disputes shall first be resolved through friendly negotiation; failing that, they shall be submitted to a competent institution in the Hong Kong Special Administrative Region.

XVII. Sales and shipping territory restrictions

This Site does not sell or ship any products to the United States of America (US) or to sanctioned countries/regions where the import of tobacco products is prohibited by applicable law, nor does it provide logistics services to such territories. Orders with a delivery address in such restricted territories will be refused or cancelled, with payments refunded in full. By placing an order you declare and warrant that your delivery address is not located in such a restricted territory.
